An Act to Support Pandemic Preparation and Response in the Commonwealth

This bill would appropriate $36.5 million to purchase hospital beds, ventilators, vaccine and other supplies needed to boost hospital capacity in the event of a public health emergency such as a flu pandemic. The bill also includes measures designed to strengthen local public health agencies and updates current laws dealing with quarantine and isolation, the authority for safe disposal of infected human remains, reporting of infectious diseases or biological agents by providers, public health declarations, and the tracking of prescriptions and over-the-counter drug sales to identify early warning sings of an epidemic.

A RESOLVE MEMORIALIZING THE CONGRESS OF THE UNITED STATES ON THE IMPLEMENTATION OF REAL ID

This act resolves that Massachusetts, unless such appropriation is used exclusively for the purpose of undertaking a comprehensive analysis of the costs of implementing the Real ID Act or to mount a constitutional challenge by the Attorney General of the Commonwealth; or until the federal government assumes its responsibility to provide adequate funding to the states for implementation, including up front funding as part of the FY 2008 federal budget.

        
AN ACT ESTABLISHING A SPECIAL COMMISSION ON ENFORCEMENT OF THE STATE BUILDING CODE

This Legislation would create a commission to ensure that the state building codes are being adhered to in the construction, design and assessment of buildings being constructed using any state funds. Revelations have surfaced in recent months that buildings in the central Massachusetts area, including school buildings, have not been properly inspected. Inquires to the Department of Public Safety revealed that enforcement of the state building code is, by statute, (see MGL c. 143, s. 3 and CMR 780) a local issue—even where state funds are involved in the construction of the building. The state, through school building assistance grants, state library construction grants and community development housing and urban renewal grants, is a major financial partner with cities and towns with most, if not all, of these projects.


An Act Transferring the Department of Dam Safety to the Department of Public Safety

This bill would transfer the Department of Dam Safety from the Department of Conservation and Recreation into the Department of Public Safety. The Department of Dam Safety provides inspectional services more inline with the mission of DPS.

This bill reforms and reorganizes the Department of Public Safety into a new Department of Building and Construction Safety. This Department has operated without a clear focus since the creation of a separate departments of State Police and Fire Services. The result has been a series of commissioners who have stronger political connections than senior management experience in public safety, staff who have allegedly awarded important licenses to those lacking qualifications. 


Relative to Pandemic or Disaster Planning by Health Care Providers

This bill, in the event of a declared statewide or regional public health emergency or disaster, will require health insurers doing business in Massachusetts to waive any pre-treatment authorization or notification requirements. Such a waiver is necessary to ensure that all patients have access to timely emergency medical care and allow providers to best deliver care during such an event. In addition, this bill will enhance the supply of necessary caregivers in a public health or disaster situation by exempting them from liability for personal and property damages that are the result of providing emergency level services related to such an event. 


an act Relative to the Postponement or Waiver of A Parole Hearing

This bill would prevent an inmate from being granted a parole hearing after a postponement or waiver until his/her next regularly scheduled hearing. The parole process is extremely difficult for victims and their families and requires an enormous amount of mental and emotional preparation. Postponements or waivers of hearing, upon the inmate's request, compounds the emotional stress on those who have already been victimized by the inmate, especially if the inmate later decides he/she wants his/her hearing. Currently, such requests must be granted. This bill seeks to ensure consistency and fairness in the parole process.


An act Relative to Inspecting and Securing Unsafe or Abandoned Buildings

This bill would require owners of property, as well as local communities to take a more active role in securing abandoned and or blighted buildings from unauthorized entry. This bill amends current statue by requiring local officials to: 1) make annual inspections of abandoned properties, 2) to require town officials to notify owners of the condition of their building by certified mail, and 3) the bill imposes stricter penalties on those owners who do not take responsibility in securing their abandoned buildings.

This bill will protect individuals who's firearm, having been modified such that it is illegal under the 1998 Gun Control Act, by reimbursing the owner of the firearm for the loss in value. Guns that are lost or stolen are often recovered having been modified so that they are illegal and this bill would require the commonwealth to seek restitution which would be provided to the owner.

AN ACT Providing for Civil Liability of Agents of License Holders

Under current law, an employee who knowingly sells alcohol, tobacco or lottery tickets to an under age person is not liable for punishment unless the employer chooses to fire or discipline the employee. The proposed bill would authorize the licensing authority to punish the employee for irresponsible behavior as well as the license holder.


An Act Prohibiting the Confiscation of Lawfully Owned Firearms During a State of Emergency

This bill would prohibit government officials and/or law enforcement from confiscating lawfully owned firearms during a state of emergency and provides serious penalties for any violations.
