Moore co-sponsors sex offender legislation
March 13, 2008 ... In an effort to dramatically increase the penalties for sex crimes against children, Sen. Richard T. Moore, D-Uxbridge, has recently co-sponsored legislation which will close sex offender loopholes.
“The safety of our children must be a vital concern, and addressing this issue now is imperative,” said Moore. “I am pleased to co-sponsor this legislation and give our public safety officials the flexibility necessary to monitor these dangerous individuals.”
The legislation, which was filed today, has four major provisions:
- Ensure classification level is
determined before a sex offender’s release from prison.

- Adopt the minimum sentences for
rape of a child from Jessica’s Law. For rape with the use of
force of a child under 16, 20 years – life for the first
offense; 30 years – life for a second of any subsequent
offense. And if a weapon is used, 25 years – life for the
first offense; 35 years – life for a second or any
subsequent offense.

- Amend the sentencing for sex
offender crimes to require extended probation, during which
offenders are subject to GPS monitoring. Institute a minimum
term of five years of probation to be served after release
from prison for the first offense of a sexually-related crime
against a child and a ten year minimum probation for a second
offense.

- Provide more specific guidelines
regarding inclusion and exclusion zones for GPS monitoring of
sex offenders on probation. Exclusion zones for offenders on
probation would include, but not be limited to,
“playgrounds, libraries, schools, day care centers, … and
any other locale deemed worthy by a probation officer to
minimize the probationer’s contact with children.”
